Invoices

Payments are upon completion of services completed or paid 14 days from date of invoice - unless stated otherwise. Payment by cash, bank transfer and approved online/electronic payments.
Online/electronic payments incur a surcharge of 1.8% of the invoice total plus +0.25c
In the event of non-payment we reserve the right to engage debt recovery services, with all associated costs payable by you.

Quotes

By engaging Better Yards & Maintenance Pty Ltd you agree to the following:
Payments are upon completion of services or paid 7 days from date of invoice - unless stated otherwise. Payment by cash or bank transfer.
We are not liable for damages to items in the service area that are not clearly visible or properly removed prior.
We cannot be held liable for minor property disturbances like ruts, tire marks, or debris displacement.
We maintain public liability insurance for damages directly caused by our negligence.
We reserve the right to refuse or postpone service if we deem conditions are unsafe.
Quotes are valid for 30 days from the date of quote.
In the event of non-payment we reserve the right to engage debt recovery services, with all associated costs payable by you.
For jobs over $1000 we require a 50% deposit before work commences and the remaining payment to be paid within 14 days of conclusion of work. 

 

BUSINESS TERMS AND CONDITIONS

These Terms & Conditions apply to all services provided by Better Yards & Maintenance Pty Ltd (“we”, “us”, “our”) to the client (“you”, “your”). By engaging our services, you agree to the following:

Services Provided

We provide lawn mowing, trimming, garden maintenance, garden clean-ups, overgrown ‘jungle’ yard clean ups, waste removal, branch and seed pod removal (within height guidelines) and related outdoor services as agreed upon in your booking or service plan.

Client Responsibilities:

Access: You must ensure we have safe and unobstructed access to the property on the scheduled service day, including access through gates, driveways, or other entry points.
Locked Gates: If a gate is locked upon arrival and no access can be made, the service may be skipped and the full service fee will apply.
Hazards: Please inform us of any hazards, such as uneven ground, loose debris, sharp objects, low branches, or aggressive animals.
Pets: All pets must be secured prior to our arrival to ensure their safety and ours.
Dog Faeces: The lawn and garden areas must be clear of dog or other animal faeces before our arrival. Excessive animal waste may result in a cleaning surcharge at $5 per poo or refusal to perform the service that day, with a call-out fee charged. Alternatively, we may continue the service, but 'mulch mow' or side discharge rather than catch and remove green waste as agreed at the time of booking.

Safety and Property Protection:

We reserve the right to refuse or postpone service if conditions are unsafe (e.g., extreme weather, unsecured pets, hazardous objects).
While we take all reasonable care, we are not liable for damage to items left in the service area (e.g., toys, hoses, garden ornaments, rocks, sticks) that may be hidden by grass or debris. We are not responsible for damage to underground services (e.g., irrigation pipes, cables) unless these are clearly marked or disclosed prior to service.

Scheduling & Cancellations:

Services are generally provided on a regular schedule (weekly, fortnightly, or as agreed).
Cancellation: At least 24 hours’ notice is required for cancellations or rescheduling.

Late Cancellation Fee:

Cancellations made within 24 hours of a scheduled appointment will incur a late cancellation fee. This fee is $50 or 50% of the total service cost, whichever amount is greater. This policy is in place because late cancellations don’t allow us enough time to offer your appointment slot to another customer, yet we still incur staffing and operational costs associated with preparing for your service. The application of this fee is at the discretion of Better Yards & Maintenance Pty Ltd, and we may choose to waive it in the case of emergencies or circumstances genuinely outside the customer’s control. By booking with us, you acknowledge and agree to this charge.
Weather Delays: In the event of heavy rain or unsafe conditions, services may be rescheduled at our discretion.

Payment Terms:

In the event of non-payment, we reserve the right to engage debt recovery services, with all associated costs payable by you.
Any part payments or payments plans must be discussed and agreed on prior to commencing services.

Quotes and Pricing:

Quotes are valid for 30 days and are based on the information provided at the time.
If additional work is required due to unforeseen circumstances (e.g., overgrown lawns, excessive debris), additional charges may apply.
Regular maintenance rates assume the lawn/garden is maintained to a reasonable standard. Neglected or overgrown areas may incur a one-time surcharge.

Sales Tax / GST:

GST and other taxes and duties that may be applicable shall be added to the price except when they are expressly included in the price.

Damage, Liability and Insurance:

We are not liable for damages to items in the service area that are not clearly visible or properly removed prior.
We cannot be held liable for minor property disturbances like ruts, tire marks, or debris displacement. Claims for damage must be made in writing within 48 hours of service.
We are not responsible for pre-existing damage or deterioration to lawns, gardens, or property.
We maintain public liability insurance for damages directly caused by our negligence of operations.
We reserve the right to refuse or postpone service if we deem the conditions or services area unsafe.
We are fully insured and carry $20 000 000 public liability insurance with Allianz Australia Insurance Limited. A certificate of currency is available on request.

Force Majeure:

We are not liable for any delay or failure to provide services due to events beyond our reasonable control, including severe weather, illness, or emergencies.

Photography, Video and Social Media Disclaimer:

By engaging Better Yards & Maintenance Pty Ltd to perform services on your property, you acknowledge and agree that photos and/or video footage may be taken while work is carried out. These images or videos may be used by Better Yards & Maintenance Pty Ltd for marketing, promotional, training, or quality assurance purposes, including but not limited to use on our website, social media, and printed materials.
We will try to avoid capturing any identifiable personal information or private areas of your property in such content. However, by proceeding with our services, you acknowledge and accept that incidental inclusion may occur and that Better Yards & Maintenance Pty Ltd retains ownership and usage rights for any media captured during the course of service delivery. If you do not wish for photography, videos and connections with social media to occur this must be stated in writing prior to us commencing services.

Indemnity:

You agree to indemnify Better Yards & Maintenance Pty Ltd, its affiliates, employees, agents, contributors, third party content providers and licensors from and against:
all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with Your Content;
any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so.

Acceptance:

By booking a service with Better Yards & Maintenance Pty Ltd, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
